Hello!
I’ve got a question. I’ve found online that a company in Canada has also registered the ADOX trademark in Canada. However, it isn’t used outside Canada. So what’s the actual situation regarding trademark rights?

This situation is due to the very peculiar nature of Canadian trademark law.
So far, we have shied away from the costs involved in taking legal action against this.
In principle, we would probably win the case, but we would rather invest the money in the development of new products than in pointless legal battles.
As the owner does not use ‘his’ trademark, it is questionable – aside from the fact that the trademark protection may have expired long ago – whether he is even interested in using it at all.
Should any difficulties arise, the products will be relabelled for the Canadian market.
Best regards,
Mirko
